1. Right of Withdrawal for Consumers

The following right of withdrawal applies only to consumers:

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, took possession of the goods.

To exercise your right of withdrawal, you must inform us (R-Trade GmbH, Twin Tower, Wienerbergstrasse 11/ 12A, 1100 Vienna, Austria, shop@gg2.at) by means of a clear statement (e.g., a letter sent by post, fax, or e-mail) of your decision to withdraw from this contract. You can use the attached sample withdrawal form, which is not mandatory. Alternatively, you can declare your withdrawal online via the "Withdraw from contract" link. After submitting the online withdrawal, you will receive a confirmation of receipt of your withdrawal.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse you for all payments we have received from you, excluding delivery costs, without undue delay and in any event no later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. For this reimbursement, we will use the same means of payment as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees for this reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

After receiving and inspecting the items, we will refund the credit to you, minus a 15% restocking fee, via the original payment method of your order.

You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send off the goods before the period of fourteen days has expired. You bear the direct costs of returning the goods.

You only have to pay for any loss in value of the goods if this loss in value is due to handling them in a way that is not necessary to check the nature, characteristics and functioning of the goods.

The right of withdrawal does not apply to distance contracts for the delivery of sound or video recordings or computer software in a sealed package if the seal has been removed after delivery.

1.1 If the customer is an entrepreneur according to §1 UGB, a withdrawal is completely excluded.

1.3 Tips for the smoothest possible return

Please return the item(s) to us as complete as possible in the original packaging. Please use the return slip (please state reason for return) and enclose it with the package. The use of the return slip and the original packaging is not a "must," i.e., not a prerequisite for asserting your right, but it simplifies and secures the processing for us. Abusive use of the return option incurs costs. For items that are impaired or damaged by signs of use, R-Trade GmbH will charge an appropriate fee for the reduction in value. The same applies if accessories are missing when the goods are returned and/or packaging is so damaged that the goods become unsaleable. The acceptance of the goods delivery by the consumer alone is not to be regarded as a reduction in value.
To avoid transport damage to the goods or loss of the goods, the goods must be properly packaged and correctly addressed for return. The return address and your sender details are already printed on our return slip. If you do not use our return slip, note your sender details on the package and send the goods to our warehouse address:

The customer shall bear the costs of returning the goods as agreed.


1.4 The consumer has no right of withdrawal for contracts concerning

 

  1. a) Services, if the entrepreneur – based on an explicit request from the consumer according to § 10 FAGG and a confirmation from the consumer of his knowledge of the loss of the right of withdrawal upon complete performance of the contract – had begun with the execution of the service before the expiry of the withdrawal period according to § 11 FAGG and the service was then fully rendered,
  2. b) Goods or services whose price depends on fluctuations in the financial market over which the entrepreneur has no influence and which may occur within the withdrawal period,
  3. c) Goods that are manufactured according to customer specifications or are clearly tailored to personal needs,
  4. d) Goods that have been inseparably mixed with other goods after delivery due to their nature,
  5. e) the delivery of digital content not stored on a physical data carrier, if the entrepreneur – with the explicit consent of the consumer, combined with his knowledge of the loss of the right of withdrawal if the performance of the contract begins prematurely, and after providing a confirmation according to § 7 para. 3 FAGG – had begun with the delivery before the expiry of the withdrawal period according to § 11 FAGG,
  6. f) urgent repair or maintenance work for which the consumer has expressly requested the entrepreneur to visit for the purpose of carrying out such work. If the entrepreneur provides further services during such a visit that the consumer has not expressly requested, or delivers goods that are not necessarily required as spare parts during maintenance or repair, the consumer is entitled to the right of withdrawal with regard to these additional services or goods.

Finally, the consumer has no right of withdrawal for contracts concluded at a public auction.

 

Exclusion of the Right of Withdrawal

 

The right of withdrawal does not apply to contracts

- for the delivery of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer/contractual partner is decisive or which are clearly tailored to the personal needs of the consumer/contractual partner - these can be recognized by the necessary input of the vehicle identification number (= VIN / FIN / vehicle ID number) for an order.

The placement of a vehicle-specific order is exclusively subject to conditions that apply to commercial customers, meaning that all rights of cancellation, return, and exchange are excluded, in accordance with the provisions of the valid right of withdrawal.

By placing an order, you confirm that you are not a private individual.

- for software products (e.g. OBDAPP, KECODI) that have been used or executed.

- where the goods have been damaged by the consumer after receipt.

- for the delivery of goods that can spoil quickly or whose expiry date would be quickly exceeded.

 

The right of withdrawal expires prematurely for contracts

- for the delivery of goods if they have been inseparably mixed with other goods after delivery due to their nature.

- for the delivery of sealed electronic software/hardware products.

- for the delivery of vehicle-specific planned retrofit/cable harness packages.

- for the delivery of sound or video recordings or computer software in a sealed package if the seal has been removed after delivery.
